German Constitutional Court Upholds Tobacco Tax on E-Cigarettes

The Federal Constitutional Court of Germany has upheld the tobacco tax on e-cigarettes, which has been in effect since July 2022. The court dismissed complaints from manufacturers and e-smokers, stating that the plaintiffs did not sufficiently justify their grievances. They argued that the tax unfairly burdens producers and sellers of e-liquids, while many consumers evade tax obligations. Additionally, claims regarding the reduced health risks of e-cigarettes compared to traditional cigarettes were not convincing enough to alter the tax ruling.
